1. Scope of Application These General Terms and Conditions apply to all contractual relationships between Begevity and its customers.
2. Subject Matter of the Contract The provider supplies services and/or products as agreed individually or as described in the service description.
3. Conclusion of Contract The contract is concluded upon confirmation by the provider or commencement of performance.
4. Prices and Payment Terms All prices are stated in Swiss Francs (CHF)
incl. /excl. VAT. Invoices are payable within XX days.
5. Performance of Services Services are performed with due care and professionalism. Deadlines are binding only if expressly agreed.
6. Liability The provider is liable only for intent and gross negligence. Liability for minor negligence is excluded to the extent permitted by law.
7. Warranty Defects must be reported in writing without undue delay. In case of justified defects, repair or replacement will be provided.
8. Withdrawal / Cancellation There is no statutory right of withdrawal under Swiss law.
9. Data Protection Personal data is processed in accordance with the privacy policy and applicable Swiss data protection law.
10. Governing Law and Jurisdiction Swiss law applies exclusively. Place of jurisdiction is XX, Switzerland.
11. Severability Clause If any provision is invalid, the remaining provisions shall remain unaffected
Data Transfers to the United States
Please note that certain personal data may be transferred to the United States of America (USA), in particular when using hosting, cloud, analytics or communication services.
From the perspective of Swiss data protection law and the GDPR, the USA is considered a country without an adequate level of data protection.
Data transfers are carried out based on appropriate safeguards, in particular the conclusion of Standard Contractual Clauses (SCC) pursuant to Art. 16 Swiss revDSG and Art. 46 GDPR.
Despite these measures, it cannot be ruled out that US authorities may access the data under their statutory powers. Data subjects may not have legal remedies equivalent to those available in Switzerland or the EU.
